Application Terms
Article 1 — Purpose
These terms govern applications submitted by creators who wish to propose audiovisual works made with artificial intelligence tools for possible distribution on the MIDNIGHT HORROR SERIES platform, published by GESHMARK (the "Publisher").
Article 2 — Application
Applying is free and non-binding. It is open to any person of legal age and to any production company. The applicant guarantees that the information provided is accurate.
Article 3 — No transfer of rights through applying
Submitting an application does not transfer any rights to the Publisher. The links provided are viewed solely to assess the applicant's work. The Publisher will not distribute, reproduce or exploit any submitted work without a written contract signed with the creator.
Article 4 — Applicant's warranty
The applicant certifies that they are the author of the submitted works or hold the necessary rights to them, including the music, sounds and any third-party elements they contain.
Article 5 — Selection
The Publisher freely selects the creators it wishes to work with, based on artistic and editorial criteria. Submitting an application guarantees neither selection nor a detailed response. The Publisher endeavors to reply to each applicant as soon as possible.
Article 6 — Collaboration and payment
Any collaboration is subject to a separate, individually negotiated contract, which sets out in particular the chosen payment formula (buyout, advance plus revenue share, or revenue share), the scope and duration of the rights granted, the territories, and the reporting terms. Under the buyout formula, one single agreed price covers the complete 40-episode series, not each episode individually. Any flat-fee remuneration remains subject to the conditions and mandatory protections of applicable copyright law. The formulas presented on the website are indicative and do not constitute a contractual offer.
Exploitation rights — separate signed agreement
Applying grants MIDNIGHT HORROR SERIES no distribution or exploitation rights. If a creator is selected, the creator or relevant rights holder and GESHMARK must sign a separate Series Distribution Agreement before any exploitation. Each economic right licensed or assigned must be identified separately, with its purpose, scope, territory and duration, in accordance with Article L131-3 of the French Intellectual Property Code. The agreement will specify, as applicable, reproduction and storage; public communication and on-demand streaming on MIDNIGHT HORROR SERIES; distribution on agreed partner and social platforms; promotional excerpts; and authorized technical adaptations such as encoding, subtitling and dubbing. No right is granted automatically by this page. Worldwide distribution, exclusivity, any sublicensing to distributors, permitted formats, compensation, reporting and any renewal or reversion must be expressly agreed. The creator retains their inalienable moral rights, including authorship and integrity, under Article L121-1. A buyout concerns only the economic rights expressly set out in the signed agreement and does not waive moral rights. Rights in music, voices and other third-party elements must be cleared for the agreed uses. These application terms do not replace an individually reviewed production or distribution contract.
Article 7 — Confidentiality
The Publisher treats unpublished projects presented to it (synopses, series ideas) as confidential and will not exploit them without the applicant's consent.
Article 8 — Governing law
These terms are governed by French law. Any dispute falls under the jurisdiction of the courts of the Publisher's registered office, subject to applicable mandatory provisions.
